Ishrat is innocent: Magisterial report

The Ishrat Jehan encounter returns to haunt Gujarat police: A magisterial inquiry has concluded that the encounter was fake.

In 2004 Ishrat Jehan and four others were killed by the Ahmedabad Crime Branch. The Police said they were Lashkar-e-Toiba operatives who had come to Ahmedabad with a plan to kill Chief Minister Narendra Modi.

Now, a 243-page damning report by Magistrate SP Tamang says: "Ishrat was innocent and was killed only because she was a Muslim and fitted the Gujarat Police's idea of a terrorist."

The report says the police carried out this fake encounter to get rewards and promotions. To curry favour with the Chief Minister they also floated a story that she and her associates had come to eliminate him.

Among the 20 policemen accused of her murder:

  • Gujarat Additional DGP (Intelligence) P C Pandey
  • Deputy Commissioner of Police (Gujarat ATS) G L Singhal
  • Retired Police Commissioner K R Kaushik
  • Police Inspector with Ahmedabad Crime Branch Tarun Barot
  • And the then Additional Police Commissioner (Crime Branch) D G Vanazara and then Assistant Commissioner of Police N K Amin both already in jail in connection the Sohrabudddin fake encounter case.

"It's cold blooded murder and the court came to the conclusion that the murder was committed for personal gain and to get the praise of the chief minister," said Mukul Sinha, Ishrat Jehan's family's lawyer.

The probe is a result of pressure from Ishrat's family who all along maintained that their 19-year-old daughter was innocent.

Their stand now is vindicated.

I am sure most of us agree that fake encounters is wrong. But let us take a step back and understand why did the term 'fake encounter' came along. We still have a failed judicial system after 59 years of our installation of the constitution. After the Mumbai shooting of 26/11 we have the accussed in custody, the evidence is crystal clear and many testimonials, I fail to understand why there is a delay and what else is required. Are we waiting for a another Khandahar so that the accused is part of a exchange program? We have so many incidents like the Mangalore pub attacks where the some activists are caught on tape attacking women but no one is held responsible. There are only victims in such cases but no one punished. Why is there no outcry if the judicial system fails? The law system comprises of the judicial system and the police force. If the root of the system is not strong how will the whole system survive.

Another truth revealed the naked face of Gujarat government, who is showing face of developed Gujarat. What one could appreciate where human life has not value to another human (in this case, government boasting officers). Why not actions taken so far against these police officers....these police should sentenced to maximum punishment so others would take lesson in future. If Modi has moral value, he should resign and let Gujarat become a part of normal democratic country India. He not only ill famed Gujarat across world but India as whole also been maligned...
