Karnataka High Court dismisses litigation challenging appointment of Upalokayukta

Bangalore: The Karnataka High Court on Monday dismissed as "withdrawn" a Public Interest Litigation which challenged the appointment of former judge of High Court SB Majage as the Upalokayukta.

A division bench headed by Chief Justice Vikramajit Sen dismissed the petition after petitioner P Subramanya, an advocate, withdrew it subsequent to government advocate Veeranna submitting that the government had complied with the necessary rules in the appointment of the anti-corruption watchdog.

The petitioner had contended that Mr Majage's appointment was made without following the consultation process defined in the Karnataka Lokayukta Act and not effectively consulting all the constitutional functionaries as interpreted by the High Court in its April 3, 2012 order annulling the appointment of another Upalokayukta, Chandrashekaraiah.

He had also claimed that the Chief Minister did not circulate the name of the former judge to other constitutional functionaries like the Assembly Speaker, Chairman of the Legislative Council, and Leaders of the Opposition in both the houses before recommending it to the Governor.
