The hearing in Aarushi-Hemraj double murder case will take place in a special CBI court here tomorrow during which the agency will put forth its opinion on the protest petition filed by the slain teenager's family against its closure report.
The CBI is expected to stand by its closure report in the case and is likely to challenge the petition filed by Aarushi's father Rajesh Talwar, official sources said. They, however, said the Court can take cognisance of the closure report and issue orders to the agency based on the same.
Meanwhile, the local police have planned to put in place an elaborate security in the court premises following an attack on Aarushi's father during the last hearing on January 25.
Besides deployment of personnel from the local police station and the Provincial Armed Constabulary (PAC) security would also be provided to the Talwar family.
Utsav Sharma, a resident of Varanasi in Uttar Pradesh, who had earlier stabbed former Haryana DGP SPS Rathore, a convict in the Ruchika molestation case, had attacked Talwar with a cleaver.
The incident had sent shockwaves among the district police and those in the court premises.
Though the Court was scheduled to hear the matter on the same day post lunch, the attack forced the court to defer the matter till February 8.
The parents in the petition have alleged that there were "deliberate lapses" in the investigation besides noticeable non-mentioning of material pieces of evidence.
They have also pleaded that further investigation should be ordered into the case "so that the culprits involved in this heinous crime are apprehended, and investigated against and brought to trial."
In the petition, the Talwars have given the sequence of events during the night of May 15 when the teenager was murdered and during subsequent days as per their memory.
"The Petitioner submits that the conclusions arrived at by the Central Bureau of Investigation on several material facts, issues and circumstances are manifestly erroneous and are based on presumptions, conjectures and surmises, not substantiated or supported by true and actual facts.
"There are deliberate lapses noticed by the Petitioner, besides noticeable non-mentioning of material pieces of evidence collected during the investigation of the case, which had lead to the filing of this petition," the petition said.
14-year-old Aarushi was found murdered at her residence in 2008. The body of their domestic help Hemraj was found on the terrace of the house later.
