No tainted person will be appointed judge: Moily

No tainted person will be appointed judge: Moily
New Delhi: The Union Law Minister has called for a rethink into the procedure of appointing judges, saying there will be no tainted judges.

Law Minister M Veerappa Moily said on Wednesday that only those with merit would be appointed judges, adding that the government might rethink the procedure of appointment of judges. "Whatever we do, we need to take the judiciary into full confidence," he added.

Moily's remarks come at a time when a Supreme Court panel is yet to take a decision on the elevation of the Karnataka High Court's Chief Justice to India's apex court. Justice Dinakaran is accused of corruption.

Currently the Supreme Court selects candidates as judges, and the goverment accepts them. Now, Moily wants to change this to prevent the appointment of tainted judges. And though he isn't saying how - given the sensitive divide between the judiciary and executive - he could get a fair deal of support.

"The constitution needs a law that regulates the appointment of judges. Many judges may not like my view, but people are losing confidence in the judiciary," Former Chief Justice of India P N Bhagwati.

The Law Minister has also said that commercial courts will be set up for high-value cases above Rs 2 crores, to make India a good place to do business.
