'Lt Governor Is Delhi's Administrative Head': 5 Big Points From Court Order

The Delhi High Court order comes as a setback to chief minister Arvind Kejriwal.

New Delhi: Delhi, as a union territory, is mainly in the charge of the Lieutenant Governor, who is the centre's representative in the national capital, the Delhi High Court ruled today. The ruling comes as a blow for the Arvind Kejriwal-led Aam Aadmi Party government which has accused the centre of encroaching upon its powers.

Here are five points from the court order:

  1. Delhi continues to be a union territory and the Lieutenant Governor is the administrative head.

  2. The Lieutenant Governor is not bound to act on the advice of the council of ministers.

  3. It is mandatory for Delhi government to inform the Lieutenant Governor about its decisions. No order can be issued if the Lt Governor disagrees.

  4. Appointments and transfer of government employees is outside the purview of the Delhi assembly.

  5. The Delhi government's order that electricity companies should compensate consumers for power cuts is illegal.
