Former IPS officer DG Vanzara, who was accused in the alleged fake encounters of Ishrat Jahan and Sohrabuddin Sheikh and was later discharged in both the cases, has been given post-retirement promotion as the Inspector General of Police (IGP) by the Gujarat government, six years after he retired from service.

इशरत जहां के कथित मुठभेड़ मामले में दोनों सेवानिवृत्त अधिकारी आरोपी थे. उन्होंने अदालत से अनुरोध किया था कि राज्य सरकार ने उनके खिलाफ अभियोजन चलाने की सीबीआई को मंजूरी नहीं दी है, जो सीआरपीसी की धारा 197 के तहत जरूरी है. लिहाजा उनके खिलाफ मामले की सुनवाई को बंद किया जा सकता है. सीआरपीसी की धारा 197 के तहत ड्यूटी के दौरान की गई कार्रवाई के लिए लोक सेवक पर मुकदमा चलाने के लिए सरकार की मंजूरी लेना जरूरी है. अदालत ने पहले इसी मामले में आरोप मुक्त करने का अनुरोध करने वाली उनकी अर्जियों को खारिज कर दिया था.

The Central Bureau of Investigation (CBI) today told the court that Gujarat government has declined sanction to prosecute retired police officers DG Vanzara and N K Amin in the alleged fake encounter case of Ishrat Jahan and three others.

वंजारा ने पांडे के साथ समतुल्यता के आधार पर खुद को आरोपमुक्त करने की मांग की थी.अमीन के संदर्भ में अदालत ने कहा कि यह स्पष्ट है कि आरोपी नंबर 5 अमीन ने इशरत और जावेद को 12 जून को वसाड टोल बूथ से पकड़ा था और मुठभेड़ के दौरान वह मौके पर मौजूद थे. मुम्ब्रा की 19 वर्षीय इशरत जहां और तीन अन्य-- जावेद शेख उर्फ प्रणेश पिल्लै, अमजद अली अकबर अली राणा और जीशान जौहर 15 जून, 2004 को अहमदाबाद के बाहरी इलाके में पुलिस के साथ कथित मुठभेड़ में मारे गये थे.

गुजरात के पूर्व आईपीएस अधिकारी डी जी वंजारा के वकील ने इशरत जहां और अन्य को लेकर जा रही कार के मूवमेंट के बारे में सीबीआई की थ्योरी पर आज सवाल उठाया. बता दें कि इशरत और अन्य की कथित तौर पर फर्जी मुठभेड़ में हत्या कर दी गई थी. साल 2004 के इशरत जहां फर्जी मुठभेड़ मामले में आरोपी वंजारा ने यहां विशेष सीबीआई अदालत में याचिका दायर करके मामले में आरोप मुक्त करने की मांग की.

गुजरात के पूर्व पुलिस महानिरीक्षक डी.जी. वंजारा ने मंगलवार को एक विशेष अदालत में कहा कि इशरत जहां फर्जी मुठभेड़ के मामले में केंद्रीय जांच ब्यूरो (CBI) तत्कालीन मुख्यमंत्री नरेंद्र मोदी और राज्य के तत्कालीन गृह राज्यमंत्री अमित शाह को गिरफ्तार करना चाहती थी. सीबीआई अदालत में दाखिल एक रिहाई याचिका में वंजारा के वकील वी.डी. गज्जर ने न्यायाधीश जे.के. पांड्या के समक्ष दावा किया कि सीबीआई मोदी और शाह को गिरफ्तार करना चाहती थी, लेकिन किस्मत से ऐसा नहीं हुआ.
