Surrogacy Regulation Bill

Parliament passed the Surrogacy (Regulation) Bill, 2019 on Friday, with Lok Sabha passing it with voice vote amid a protest by opposition members demanding the removal of Ajay Mishra as Union minister in connection with the Lakhimpur Kheri violence.

The Union Cabinet on Wednesday approved the Surrogacy (Regulation) Bill, 2020, allowing any "willing" woman to be a surrogate mother and it proposes that widows and divorced women can also benefit from its provisions, besides infertile couples.

A parliamentary panel has recommended that not only close relatives but any woman who is "willing" should be allowed to act as a surrogate.

Rajya Sabha members on Wednesday sought changes in certain provisions of the Surrogacy (Regulation) Bill 2019, which mandates that only a close relative can be a surrogate mother and provisions of five years of marriage for commissioning parents.

Commercial surrogacy will soon be banned and only close relatives will be permitted to act as surrogates to infertile couples for "ethical altruistic" reasons.

The Surrogacy (Regulation) Bill, 2016 that ensures effective regulation of surrogacy, prohibits commercial surrogacy and allows altruistic surrogacy to the needy Indian infertile couples was passed by the Lok Sabha on Wednesday with a voice vote.

As many as nine new bills, including three related to GST, and surrogacy regulation will be introduced in Parliament in upcoming Winter Session.
