The Patna High Court today set aside the conviction of 26 persons, including 16 who were awarded death sentence by a lower court, in the massacre case of 58 Dalits at Laxmanpur Bathe village of Bihar's Jehanabad district 16 years ago.

The Bihar Government will file an appeal in Supreme Court against the Patna High Court order acquitted all 23 accused in the Bathani Tola Massacre case, Bihar Chief Minister Nitish Kumar said on Tursday. A divison bench of the Patna High Court, on April 16, had acquitted all accused who were serving sentence granted by a district court in the case.

Citing lack of evidence, a Bihar court on Monday acquitted three men sentenced to death and 20 given life imprisonment for the 1996 massacre in Bathani Tola in which 21 people, mainly women and children, were killed by members of the upper caste Ranvir Sena.
