HC refuses to stay case against Mallika Sherawat

Nagpur: The Bombay High Court has refused to stay the criminal proceedings against actress Mallika Sherawat in a local court pertaining to alleged obscenity by her actions in films.
     
Sherawat had moved the court seeking a stay on criminal case filed against her by a social worker.
    
The actress also prayed for quashing an arrest warrant issued by a court in Yavatmal against her for not appearing in the case.
    
Hearing Sherawat's plea, Justice Pramod Kode of the Nagpur Bench of High Court issued notices to the state government and Rajnikant Borile who had filed complaint against her.
    
Borile had filed an application before the Judicial Magistrate First Class at Pandharkawda in Yavatmal district, seeking registration of offences under IPC Section 291 (repeating public nuisance) against Mallika on April 8, 2009.
    
The same court issued summons to Mallika earlier this year, but she failed to appear before it. Hence, an arrest warrant was issued against her.
    
Borile had alleged that the actress had performed "obscene acts" in films like Shaadi Ke Pehle, Murder and Maan Gaya Mughal-e-Azam, which were affecting the society and younger generation in particular.
     
Since the actor was performing for gaining money, she should be booked under IPC Section 291, he contended.
    
Mallika was accordingly booked for the offence at that time.
