Having two-thirds majority is not relevant before the Election Commission in the NCP split case, says SY Quraishi, former chief election commissioner. "They will go by a majority which could be simple majority. The two-thirds majority is in the context of merger of a party. A breakaway faction is a defector, and this defection is decided by the Speaker, not the EC," he explains.
