Drug major Sun Pharmaceutical has withdrawn its appeal in the lawsuit filed by Ranbaxy against the US health regulator challenging FDA's decision to revoke approvals for generic versions of Nexium and Valcyte.

Sun Pharma is India's largest drugmaker.

Ranbaxy filed "grossly inadequate" applications seeking approval for its drugs and deceived the FDA into granting approvals and giving the company market exclusivity, the class action lawsuit asserts. It was filed by US retailer Meijer Inc on Tuesday in the US District Court in Massachusetts.

Ranbaxy had filed a lawsuit against the US Food and Drug Administration last week for revoking tentative approvals it gave the company to make generics of Valcyte and Nexium.

US District Judge Peter Sheridan in Trenton, New Jersey, ruled that the plaintiffs, retailers and distribution companies that bought Lipitor directly from Pfizer, failed to plead their case with enough detail.

The settlement is its largest-ever with a generic drugmaker over drug safety, according to the US government. It includes $150 million in payments for a criminal fine and forfeiture and $350 million in payments for civil claims.
