The Bombay High Court has urged authorities to pass preventive detention orders with extreme care and caution as a casual approach may deprive a person of his "most precious" fundamental right, his freedom and liberty.

Observing that preventive detention is a draconian measure and any such move based on a capricious or routine exercise of powers must be nipped in the bud, the Supreme Court has set aside a Telangana High Court order rejecting a detenu's appeal.

Laws on preventive detention are necessarily harsh and curtail the personal liberty of an individual who is kept behind bars without trial, and so the procedure prescribed should be strictly adhered to, the Supreme Court said.

The Haryana Police on Sunday said it has secured detention orders for a notorious drug peddler under a law which allows preventive custody of an accused without bail for a year.
