Newborn mistakenly circumcised; family to sue hospital

Miami: Baby Mario is only seven weeks old and yet his family believes he's already been a crime victim. His parents plan to sue South Miami Hospital after doctors performed an unauthorized circumcision on him.

Attorney Spencer Aronfeld said, "We believe this is not just medical malpractice. We believe what happened here, because it was an unauthorized, unconsented surgery, constitutes a battery."

Vera Delgado says her son, had complications after birth so he spent ten days in intensive care. She says while he was there, the hospital staff asked if she and her husband wanted the baby circumcised -- and they repeatedly said no.

However, on the eighth day of Mario's hospital stay, Delgado discovered a painkiller in her son's bassinet and was told by a nurse that doctors performed the circumcision on her son.

South Miami Hospital officials admit the mistake. They say the consent form was misread.
