The top decision making body of Muslims in India tells the Supreme Court that triple talaq, the Islamic practice that allows a man to divorce his wife by uttering talaq three times, cannot be legally scrutinised. Personal laws, its being argued cannot be rewritten in the name of social reform. Those who oppose this, including the Bengal based woman Ishrat Jahan who has lost custody of her four children after her husband said talaq on the phone, say this is a violation of the constitution, according to at least four articles. On the programme, we debate, should parts of Muslim personal law be rewritten in the name of social reform? Should triple talaq be banned?
