Former Bond girl Halle Berryis preparing for a court battle with ex-boyfriend, modelGabriel Aubrey, to get custody of their two-year-old daughterNahla.
The couple, who split last April after almost fiveyears together, had previously arranged a split custodyagreement.
But now the Oscar winning actress has voiced "serious"concerns over Aubry's parenting skills and will take legalsteps to make sure she is safe, reported People magazine.
"Halle has serious concerns for her daughter'swell-being while in the care of her father for any extendedperiod of time and is prepared to take all necessary steps toprotect her," her publicist said.
The 44-year-old has pulled out of the film New Year'sEve, which was set to start filming this week in New York inorder to clear her schedule for custody litigation.
"Halle has attempted to resolve these custody issuesamicably with her daughter's father, Gabriel Aubry, directly,but given his lack of cooperation, Halle has no choice but toseek swift judicial intervention," her representative said.Aubrey, 35, filed court papers on December 30 seekingto be formally recognised as Nahla's father and to establishthat he'll share custody.
The couple had previously had an amicable agreementregarding custody of their daughter which has been settled outof court up to this point.
Both Berry and Aubrey have both since dated otherpeople with the model being spotted out with reality star KimKardashian and the actress being in a relationship with Frenchactor Olivier Martinez.
