Delhi gang-rape: Minor accused could get a maximum of 3 yrs in jail if convicted

One of the six men accused in the gang-rape of the 23-year-old medical student on December 16 in Delhi is a minor and, according to law, cannot be tried along with his co-accused. His trial will be held before the Juvenile Justice Board. Speaking to NDTV, KTS Tulsi, a senior criminal lawyer said, "The Juvenile Justice Act provides for a completely separate machinery and trial to determine the guilt or innocence of a juvenile." He added that the accused minor can neither be detained in police custody nor be housed in regular prisons.
