NDTV Convergence Limited (“NDTV”, “we”, “our” or “us”) operates and maintains an online platform NDTV Launchpad (“Platform”) that enables end users (“User(s)”, “user” or “you”) to discover, browse and access information relating to educational courses, certification programmes, webinars, AI Learning courses and other learning opportunities offered by independent third-party course providers (“Course Providers”).

The Platform functions solely as a discovery and referral platform. Upon selecting a course or programme listed on the Platform, User(s) may be redirected to the relevant Course Provider's website or online platform to obtain further information and, where they choose to do so, complete their registration, enrolment, subscription, payment and access to such course or programme.

NDTV does not create, own, develop, publish, endorse, accredit, deliver or administer any course, certification programme, learning content or educational material made available through the Platform, unless expressly stated otherwise. All educational content, course delivery, assessments, examinations, certifications, learner support and related academic or administrative services are solely provided, managed and controlled by the respective Course Provider.

Any agreement relating to the enrolment in, purchase of, or participation in a course or programme is entered into directly between the user and the relevant Course Provider. NDTV is not a party to such agreement and shall have no responsibility or liability arising out of or in connection with the provision of any course, certification programme or related services by a Course Provider.

By accessing, browsing, registering on, or otherwise using the NDTV Platform, User(s) acknowledge that User(s) have read, understood, and agree to be legally bound by these terms of use and the applicable privacy policy. User(s) are therefore advised to review these terms and conditions (“Terms”) carefully prior to using the Platform. If you do not agree with, accept, or are unable to comply with any provision of these Terms of use or the privacy policy, you must immediately cease and refrain from accessing or using the NDTV platform. Any access to or use of the Platform shall constitute your express acceptance of, and agreement to be bound by, these Terms of use.

• Role of NDTV

  • NDTV's role is limited to operating and maintaining the Platform through which User(s) may discover and access information relating to educational courses and programmes offered by independent Course Providers. The Platform serves solely as a technology-enabled discovery and referral platform and does not facilitate or participate in the enrolment, payment, delivery or administration of any course or programme.
  • Access to and use of the NDTV Platform, including any services, features, content, or transactions made available thereon, is restricted to User(s) who are competent to enter into legally binding contracts under the provisions of the Indian Contract Act, 1872. User(s) who are deemed incompetent to contract under applicable law shall not be entitled to access, register on, or use the NDTV Platform. In the event that a user is below eighteen (18) years of age, such user may access or use the NDTV Platform only under the supervision of, and with the prior consent of, their parent or legal guardian. By permitting a minor to access or use the NDTV Platform, the parent or legal guardian represents and warrants that they have reviewed and accepted these Terms of use on behalf of the minor and agree to assume full responsibility for the minor's access to and use of the Platform, including compliance with these Terms of use.
  • As a condition precedent to accessing certain content, services, features, courses, or functionalities available on the NDTV Platform, User(s) may be required to register and create an account. User(s) shall provide complete, accurate, current, and truthful information during the registration process and shall furnish all information and documentation requested by NDTV from time to time. NDTV reserves the right, at its sole discretion, to verify the information provided by any user and may require the submission of supporting documents, records, or other evidence for such verification. Failure to provide the requested documentation or to satisfactorily complete the verification process may result in the suspension, restriction, or termination of the user's account and access to the NDTV Platform.
  • Each user represents and warrants that all information submitted to NDTV is true, accurate, complete, and not misleading, and undertakes to promptly update such information to ensure that it remains current and accurate at all times. User(s) shall be solely responsible for maintaining and updating their registration details. NDTV reserves the right to reject, suspend, restrict, or terminate any registration, account, or access to the NDTV Platform at any time, with or without notice, if it reasonably believes that the information provided is inaccurate, false, misleading, incomplete, inappropriate, unlawful, offensive, or otherwise in violation of these Terms of se or applicable law. NDTV shall have no obligation to independently verify, monitor, or ensure the continued accuracy of any information provided by a user and shall not be responsible for any consequences arising from a user's failure to maintain accurate and up-to-date account information.

  • Upon selecting a course, User(s) shall be redirected to the relevant Course Provider's website or online platform, where all registration, enrolment, subscription, payment and course-related transactions are completed directly with the Course Provider. NDTV shall not be responsible or liable for:

    • the quality, accuracy, completeness, legality or suitability of any course, programme or learning content;
    • the course curriculum, syllabus, faculty, instructors, trainers or teaching methodology;
    • examinations, assignments, assessments or grading;
    • the issuance, validity, recognition or acceptance of any certificate, diploma or credential;
    • course schedules, commencement dates, completion timelines or availability;
    • the pricing of any course, promotional offers or changes thereto;
    • the technical delivery, accessibility, availability or performance of the Course Provider's website or learning platform;
    • learner support, academic assistance or grievance resolution provided by the Course Provider; or
    • any representations, warranties, statements or omissions made by a Course Provider regarding its courses, programmes or services.
  • All obligations, responsibilities and liabilities relating to any course or programme, including enrolment, payment, delivery, learner support, refunds, cancellations, certifications and all related services, shall remain solely with the respective Course Provider. NDTV is not a party to any transaction or contractual arrangement between a user and a Course Provider and shall have no liability arising therefrom.

• Third-Party Course Providers

  • All courses and programmes available through the Platform are offered by independent third-party Course Providers. Upon selecting a course, User(s) may be redirected to the relevant Course Provider's website, where the applicable terms and conditions, privacy policy and other policies of such Course Provider shall govern the user's enrolment, purchase and participation in the course.
  • NDTV is not a party to any agreement between the user and the Course Provider and shall not be liable for any act, omission, representation or default of any Course Provider.
  • The Platform may contain links to websites, platforms or resources operated by third parties. Such links are provided solely for the convenience of User(s). NDTV does not control, endorse or assume responsibility for the content, availability, security or practices of any third-party website. User(s) access such websites at their own discretion and shall be subject to the applicable terms and policies of the relevant third party.

• Refunds, Cancellations and Course Changes

  • As NDTV neither processes enrolments nor collects payments for any course, all matters relating to refunds, cancellations, rescheduling, pricing and billing shall be governed exclusively by the relevant Course Provider's applicable policies. User(s) must direct any requests or disputes relating to such matters to the respective Course Provider. NDTV shall have no liability in relation thereto, except as required under applicable law.

• Certifications

  • Any certificates, diplomas or other credentials relating to a course shall be issued solely by the relevant Course Provider or its authorised certification partner, if applicable. NDTV neither issues nor endorses any certification and makes no representation regarding its validity, recognition, academic equivalence, regulatory approval or acceptance by employers or other institutions. Any queries relating to certifications shall be directed to the relevant Course Provider.

• Personal Information of Participant(s)

  The collection, use and processing of personal data of User(s) purchasing or enrolling in courses through the NDTV Platform shall be governed by NDTV's Privacy Policy available at https://www.ndtv.com/convergence/ndtv/new/privacy_policy.aspx . By enrolling in a course, providing their personal data, and consenting to or accepting NDTV’s privacy policy users acknowledge that NDTV may collect and process information such as their name, email address, mobile number, course enrolment details, payment-related information (where applicable), and other information required for course registration, access, administration, communication, customer support, compliance with legal obligations, and other purposes described in the Privacy Policy.

  NDTV may share such personal data with the relevant Course Provider and authorised service providers for the purposes of delivering, managing and improving the course, fulfilling contractual and legal obligations, and for other purposes disclosed in the Privacy Policy. Personal data shall be retained only for as long as necessary to fulfil the stated purposes or comply with applicable legal and regulatory requirements.

  Users are encouraged to review the Privacy Policy to understand how their personal data is processed and the rights available to them. Where required under applicable law, NDTV shall obtain consent through appropriate consent mechanisms before processing personal data.

• Intellectual Property Rights

  • Unless expressly stated otherwise, all content, materials, and information made available on or through the NDTV Platform, including without limitation any text, articles, reports, photographs, images, graphics, illustrations, designs, layouts, software, source code, databases, audio recordings, video recordings, audiovisual content, music, trademarks, trade names, logos, service marks, directories, charts, guides, compilations, excerpts, reviews, opinions, commentaries, and other materials (collectively, the "Content"), are owned by, licensed to, controlled by, or otherwise made available to NDTV, its affiliates, licensors, content providers, advertisers, or other third parties, and are protected under applicable copyright, trademark, patent, trade secret, and other intellectual property and proprietary rights laws.
  • No right, title, or interest in or to any Content is transferred to any user by virtue of such access or use. User(s) shall not, directly or indirectly, copy, reproduce, modify, adapt, translate, distribute, publish, display, perform, transmit, broadcast, sell, license, exploit, create derivative works from, reverse engineer, scrape, data mine, download, store, frame, mirror, republish, upload, or otherwise use any Content, in whole or in part, in any manner whatsoever, except as expressly permitted under these Terms of Use or with the prior written consent of NDTV or the relevant rights holder.
  • User(s) shall further not remove, obscure, alter, or tamper with any copyright, trademark, attribution, proprietary notice, watermark, or other rights management information contained in or accompanying the Content, nor shall they assist, permit, facilitate, or encourage any third party to engage in any of the foregoing activities.
  • Any unauthorized access to, use of, reproduction, distribution, exploitation, or other dealing with the Content shall constitute a violation of the intellectual property and proprietary rights of NDTV and/or the applicable rights holder and may result in suspension or termination of access to the NDTV Platform, in addition to any civil, criminal, or equitable remedies available under applicable law.
  • All rights not expressly granted herein are reserved by NDTV and its licensors.

• Liability and Indemnity

  • The User(s) shall purchase the course voluntarily and at his/her own risk. NDTV shall, under no circumstances, hold liability and/or responsibility for any damage, loss, injury or disappointment incurred or suffered by any User(s), whether directly or indirectly, through its purchase of course through course providers.
  • The User(s) hereby agrees to indemnify and hold harmless NDTV and its directors, employees, associate partners, third-party vendors and licensors from and against all liability, cost, loss or expense arising from their purchase of the course through the Course Providers, including (but not limited to) personal injury and damage to tangible physical property, whether direct, indirect, consequential, foreseeable, due to some negligent act or omission on their part, or otherwise.
  • NDTV shall have no liability for any act or omission beyond its control, including but not limited to any earthquake, flood, pandemic, epidemic, strike, lockout, labour controversy, riot, telecommunication failure, internet breakdown, software disruption, civil disturbance, war, civil commotion, etc. In no event shall NDTV’s liability for any claim made by any user for any reason exceed Rs. 100/- (Rupees Hundred only).

• General Provisions

  • By registering, subscribing to, accessing, or creating an account on the NDTV Platform, the user expressly consents to receive communications from NDTV and its authorised representatives through electronic and non-electronic means, including but not limited to SMS, WhatsApp messages, email communications, push notifications, voice calls, and any other mode of communication permitted under applicable law. Such communications may relate to account administration, enrolment, course updates, service-related notifications, transactional information, customer support, regulatory disclosures, promotional offerings (where permitted), and other matters connected with the user's access to or use of the NDTV Platform and its services. The user acknowledges and agrees that communications sent by NDTV in connection with the user's registration, subscription, account, transactions, course participation, or use of the NDTV Platform shall be deemed to have been expressly requested and authorised by the user and shall constitute transactional and/or service communications in accordance with applicable laws and regulations. To the extent permitted under applicable law, the user expressly authorises NDTV, its affiliates, service providers, business partners, and authorised representatives to contact the user through the communication channels provided by the user, notwithstanding any registration under any "Do Not Disturb" (DND), "National Do Not Call" (NDNC), or similar preference registry maintained under applicable law. The user further acknowledges that such communications are necessary for the provision, administration, and improvement of the services offered through the NDTV Platform. The user may withdraw or modify such consent to the extent required or permitted under applicable law. However, NDTV reserves the right to continue sending communications that are necessary for the performance of its contractual obligations, compliance with legal requirements, protection of legitimate interests, or operation of the user's account and the services availed by the user.
  • NDTV reserves the right to modify, suspend, discontinue or update any part of the Platform, including the availability of any course listing, at any time without prior notice.
  • All intellectual property rights in the Platform, including its design, content, trademarks, logos and software, are owned by or licensed to NDTV. Nothing in these Terms grants User(s) any right to use such intellectual property except as necessary to access and use the Platform in accordance with these Terms.
  • The provisions contained in these Terms shall be read, in addition to and not in derogation of, any other terms including but not limited to Terms of use, Privacy Policy, Cookies Policy, etc. as may be published by NDTV from time to time (“Other Terms”). In case of any discrepancy between these Terms and Other Terms, unless otherwise expressly stated under the Other Terms, the provisions of these Terms shall prevail.
  • NDTV shall not be responsible for any errors or omissions in the Terms contained herein. All information provided is provided “As is” without warranty of any kind. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose and non-infringement in respect of user by purchasing the course from the Course Providers. Without limiting the foregoing, we specifically disclaim any warranty (a) that NDTV Website will be uninterrupted or error-free; (b) that defects will be corrected; (c) that there are no viruses or other harmful components that exist on the NDTV Website; (d) regarding the security of information submitted; and (e) regarding correctness, accuracy, or reliability. The User(s) use of the NDTV Website, online entry form results in the need for servicing or replacement of the User(s) or another's equipment or data, we are not responsible for those costs.
  • In case the User(s) have any complaints or grievances pertaining to the offering and running of the NDTV Learning Platform and/or these Terms, please share the same with us by writing an email to legal@ndtv.com. On receiving such a complaint, grievance or notice, we reserve the right to investigate and/or take such action as we may deem appropriate. We may reach out to the User(s) to seek further clarification or assistance with the investigation, or verify the statements made in the user’s complaint, grievance or notice, and the User(s) acknowledge that their timely assistance with the investigation would facilitate the redress of the complaint.
  • The Platform is provided solely to enable User(s) to discover courses offered by independent Course Providers. NDTV does not warrant or guarantee the quality, accuracy or availability of any course or programme, successful course completion, examination results, issuance or recognition of certifications, or any employment, career or other outcomes arising from participation in a course. User(s) access and enrol in courses at their own discretion and subject to the applicable terms and policies of the relevant Course Provider.
  • These Terms shall be governed by and construed in accordance with the laws of India. The courts at New Delhi, India shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the use of the Platform.
  • For any queries relating to a course or programme, including enrolment, payments, refunds, curriculum, assessments, certifications or learner support, User(s) should contact the relevant Course Provider directly.
  • These Terms shall be read together with NDTV's Privacy Policy, Cookie Policy and any other policies published on the Platform from time to time. In the event of any inconsistency between these Terms and such policies, these Terms shall prevail to the extent of such inconsistency, unless expressly stated otherwise.
I hereby confirm and attest that I have carefully read and understood the above-mentioned Terms and Other Terms (as they may be amended from time to time), and I expressly and voluntarily accept the same.
