1. The programme is initiated by ChatON in collaboration with NDTV.
2. The programme is valid for Indian Residents 18 years or above, except employees and family members of ChatON and NDTV and their affiliate / associate / subsidiary companies and their suppliers, advertising agencies and the event management company (hereinafter referred to as “Participants”).
3. The programme is valid for 15th May 2014.
4. To be eligible Participants are required to download ChatON services and participate in the Live Chat with the specified NDTV anchor.
5. 150 participants who asks best question / comment will be selected randomly out of all Participants by NDTV for winning swiss watches and the best commentators selected by NDTV will be given a Samsung Galaxy S5 as a grand prize.
6. Participant gives ChatON and NDTV or its associates or group Companies, the right to publish and broadcast anywhere in the world, for editorial, advertising, promotional, marketing and/or other purposes and in any media, Participant’s and/or Winner’s name, image, likeness and/or photograph (except where prohibited by law) and comments without any further permission or consent or consideration in any form, including but not limited to, royalty.
7. The participation in the Contest is voluntary. Participation in this Contest constitute acceptance of these terms and conditions. By participating in this Contest, Participant agrees to receive communication(s) from ChatON and/or its event management company relating to the Contest and Participant unconditionally agrees not to make any claim or raise any complaint against ChatON and/or the event management company in this respect.
8. ChatON will not be liable for delay recording by NDTV.
9. In the event of any conflict or inconsistency regarding any instructions, rules and conditions on any advertising or promotional material relating to the programme, these Terms and Conditions shall prevail over all such other instructions, rules and conditions.
10.By participating in the programme, each Participant represents and warrants that he/she is legally competent to enter into binding contracts under applicable laws. By taking part and/ or participating into the programme the Participant warrants that all information provided by the Participant regarding its name, age, state, city, address, phone number, etc., is true, correct, accurate and complete and that the Participant is authorized to provide such information and consents to the use of such information by ChatON and/ or NDTV and/or its event management company.
11.Programme shall be void, if prohibited by law.
12.Programme shall be void in any state where prohibited by law.
13.Taxes and levies on the winnings if imposed by Central, State and Local government authorities including Gift Tax/Registration/Insurance will need to be paid by the winners and they are fully responsible in this regard for the same. The Contest Winner shall receive the prize only after all amount related to the taxes and levies have been settled.
14.By participating in the programme, the Participant agrees that ChatON and NDTV shall not be liable for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the programme (except any liability which may not be excluded under applicable law).
15.The Participant hereby agrees to indemnify and keep ChatON, NDTV, their associated companies, event management company and their respective directors, officers, employees, contractors and agents, indemnified against any and all losses, claims (including but not limited to third party claims), injuries, costs, fees, fines, penalties, taxes, charges and any other liability arising out of any act of omission, commission, fraud, negligence or misconduct by the Participant.
16.Decision of ChatON and NDTV in relation to the programme and matter incidental thereto shall be final and binding on the Participant.
17.All disputes shall be governed by the laws of India. These terms and conditions shall be governed by exclusive laws of India and the courts located at New Delhi shall have the exclusive jurisdiction in respect of all the subject matter with relation to the programme.
