Karnataka Government Formation Live: As Congress Tries To Fly Out Its Legislators, 3 Flights Denied Permission

New Delhi/Bengaluru: BS Yeddyurappa has taken oath as Karnataka Chief Minister this morning after the Supreme Court, in a rare overnight hearing on a petition by the Congress and the Janata Dal Secular, refused to stop the ceremony. The BJP leader has been given 15 days to prove majority by the Governor on Wednesday evening. 

In an rare post-midnight hearing, the Supreme Court ruled out that it won't stop Mr Yeddyurappa swearing-in. "As far as swearing-in is concerned, we are not restraining it, but we are making it subject to the outcome of the case," a three-judge bench, comprising Justices AK Sikri, SA Bobde and Ashok Bhushan, said after the all-night hearing that stretched for three-and-a-half hours.

The Supreme Court will resume hearing the case Friday morning at 10.30 a.m. and has ordered the BJP to produce the letters submitted by BS Yeddyurappa to the governor by then.

Bench headed by judge 6th in seniority heard Congress petition in Supreme Court

The bench which heard the politically-sensitive case on the Karnataka crisis was headed by a judge, who is number six in seniority in the apex court. Justice A K Sikri headed the three-member bench, which also comprised justices S A Bobde and Ashok Bhushan. In the bench, which held the historic pre-dawn hearing, Justice Bobde, who will become the Chief Justice of India after Justice Ranjan Gogoi, was most vocal in grilling the lawyers appearing for both the sides on the question of law. Justice Gogoi would succeed CJI Dipak Misra after he retires on October 2.

Randeep Surjewala said that the Congress had won 17 seats in Goa in 2017 and were the single largest party there.

The Congress has asked for the recall of Karnataka governor Vajubhai Vala, according to news agency PTI. The Congress has referred to a 2011 tweet from PM Modi, who was then the chief minister of Gujarat, which sought the recall of the then governor HR Bhardwaj.

The PM had in 2011 alleged that Mr Bhardwaj was "harassing" the BJP-led state government and was "acting in a partisan manner".
