Islamabad:
A Pakistani court on Monday directed the police to register a case against former President Pervez Musharraf for "illegally" detaining members of the superior judiciary after imposing Emergency in 2007, two weeks after the Supreme Court declared his actions as "unconstitutional."
District and Sessions Judge in the federal capital Akmal Raza issued the order after a lawyer Aslam Ghuman filed an application in his court asking for a case to be registered against Musharraf, who is currently in Europe.
The judge's order was sent to a police station in the heart of Islamabad, sources said. In his application, Ghuman accused Musharraf of illegally detaining over 60 judges after imposing emergency nearly two years ago.
The Supreme Court had on July 31 ruled that the emergency proclaimed by Musharraf was unconstitutional and illegal. The verdict has raised the possibility of the former military ruler being tried for treason.
However, only the government can initiate such a trial.
After imposing Emergency on November 3,2007, Musharraf sacked 60 members of higher judiciary, including Chief Justice Iftikhar Mohammad Chaudhary.
