SC orders release of Binayak Sen

On Monday, the Supreme Court ordered the release of prominent civil rights activist Binayak Sen, who is lodged in a Chhattisgarh jail for the past two years.

A vacation bench of Justices Markandey Katju and Deepak Verma ordered Sen's release on his submitting a personal bond to the satisfaction of the local trial court.

A prominent PUCL leader, Sen was arrested by the Chhattisgarh police for allegedly colluding with certain naxalite leaders in their activities, a charge denied by him.

NDTV adds:

This is the the second time that Dr Sen's bail plea had come up for hearing. Dr Sen had appealed for bail on grounds of ill health. He has been suffering from a serious heart condition and doctors had advised him treatment at Vellore.

Dr Sen was booked under the Unlawful Activities Prevention Act and dumped in Raipur jail since May 14, 2007. The Chhattisgarh Government has accused Sen, of acting as a courier for Naxalites in jail, but no evidence against him was ever found. ever since Sen's arrest, there was a swelling tide of protests in India and abroad. The World Human Rights Organisation had said that Sen's case was a dark spot on Indian democracy.

In 2008, more than 2,000 doctors from all over the world signed petitions demanding Dr Sen's release. They include prominent American writer Noam Chomsky.

It's a national shame that it took two years for the judiciary, before a great man like him could be granted bail for a case which is totally baseless. Such acts by elected governments make me feel ashamed to call myself an Indian! Wonder why there is no proper redressal for common Indians. Anybody who has access to little power can actually act with impunity & get an honest people behind bars! And we can do nothing to get him out of such a situation?? Hope Dr.Sen gets his due & no other Indian faces the dilema that he has faced in these two years.

With bail being granted to Dr Binayak Sen, there is a sense of victory amongst common Indians like me, for whom Dr Sen is a symbol of hope. He meant hope for the underprivileged and deprived masses of this great nation. It is a matter of national shame that it took more than two years for the judiciary to grant bail on a sham case manufactured by an administration bent or punishing Dr Sen for his crusade against ill health, poverty and ignorance. As a nation born out of a non violent freedom struggle, it is our dharma to see that people like Dr Binayak Sen should always be given the right place in history. His untiring efforts to provide medical care to the downtrodden people of Chattisgarh might not have gone well with the defunct state machinery but his hard work should be lauded wide and aloud within the four corners of India.
