Defiant Koda says he 'can't be summoned'
NDTV Correspondent, Friday November 20, 2009, Ranchi

Former Jharkhand Chief Minister Madhu Koda has written to the Enforcement Directorate (ED) saying they cannot summon him.

In the letter to, he has also said the ED will have to give him a 10 day advance notice and also inform the Speaker.

Madhu Koda dodged interrogation yet again on Thursday, ignoring a summons that required him to be in Delhi to explain exactly how a chief minister collects assets worth 4000 crores.

Instead of meeting the Enforcement Directorate officials who're handling his case, the former chief minister of Jharkhand was campaigning in Chaibasa, the part of Jharkhand from where he has six candidates contesting the state elections.

"We will do whatever is the next step according to law, said Prabhakant, Director, Enforcement Directorate.

It's not just Koda who's not cooperating with investigators. Two of his associates, Binod Sinha and Sanjay Choudhary, have defied deadlines that asked them to surrender or face legal action.

Koda's own resilience is a far cry from his initial reaction to the investigation against him.  Complaining of a severe stomachache, he spent days in hospital, where he was off-limits to anyone but his doctors or family.

After recovering, he said he wants to focus on Jharkhand's elections, after which, he has promised, "I will go wherever they call me.''

An arrest warrant could be issued against Koda, but investigators worry that will scare Sinha and Choudhury from eventually surfacing.  Their testimony against Koda, sources say, could help ensure a water-tight case against the man whose money they allegedly invested illegally.

A country progresses on the pillars of transparency, judiciary, enforcement and self defence. India is achieving transparency slowly but surely , mostly because of the laudable actions of an independent press although this is still in its infancy. Kudos to NDTV for pursuing this relentlessly. The judiciary and enforcement unfortunately still carry the colonial stigma with them and have failed the nation miserably repeatedly. A lawyer is available but justice is not and takes forever to obtain . These are the conditions where Taliban took root and the naxals in India are not a far cry off the same apple tree. Unless enforcement is impartial and justice swift, transparency will soon be a reality show without teeth. India with its aspirations to become a world leader has to start taking these issues seriously and convince the world that justice is a serious right and not a fancy privilege . Only then will foreign investment flow in , obstructionism to trade (in the form of licenses that are held back unless palms are greased) will disappear and the common mans plight improve. Thank you NDTV . I hope the rest of your brethren take up where you left off as Koda is not the first and most certainly will not be the last.
