Jagan Mohan Reddy's mother Vijayamma writes to poll panel chief for intervention in arrest

Hyderabad: On a day YSR Congress chief Jagan Mohan Reddy was sent to judicial custody for 14 days in connection with a disproportionate assets case against him, his mother Vijayamma has written to Chief Election Commissioner (CEC) SY Quraishi, requesting him to intervene.

Respected Sir

I am writing this letter with a great hope that you would kindly intervene with the CBI, which has, in complete disregard to the fact that  Sri Y S Jaganmohan Reddy, Founder President, YSR Congress Party, a Registered Unrecognized Political Party, is leading the campaign on behalf of his Party for the upcoming bye-elections to 18 Assembly segments and one MP seat in our State, have arrested him  most undemocratically on 27-5-2012, just 15 days before the bye-elections as part of a larger conspiracy to deprive his participation in the elections with the sole objective of helping the Ruling Congress Candidates. This is SOS from YSR Congress Party.

The CBI filed FIR in CBI Court, Hyderabad on 17-8-2011, arraying Sri Y S Jaganmohan Reddy as Accused 1. The CBI did not summon Mr Jaganmohan Reddy for almost 280 days after filing the FIR. They could have arrested him at any time after the filing of FIR. But, they did not do so. After the bye-elections were declared and after Mr Jaganmohan Reddy started actively canvassing, the CBI, all of a sudden summoned him to appear before them on 25-5-2012. He appealed to them for time till June 10, 2012, which is the last date for canvassing for the upcoming bye-elections. He has also appealed to them that the CBI is under no obligation under any law to complete investigation within so many days of filing FIR and that the case relates to investigation into 26 GOs issued between 14-5-2004 and 2-9-2009. The case is historical in nature without any possibility to tamper with evidence.

Further, the CBI is aware that In response to a SLP filed by one Mr Sudhakar Reddy challenging the FIR filed by CBI in the Crime 19(A)-RC/2011 in the CBI Court Hyderabad, a Division Bench of the Hon'ble Supreme Court comprising  Hon'ble Justice Dalveer Bhandari and Hon'ble Justice Dipak Mishra directed issue of Notices on 12-3-2012 to Six Ministers in the Council of Ministers of Andhra Pradesh and Eight Secretaries to Government of AP questioning as to why their names may not be arrayed as accused in the FIR. The Notices were served on the said Ministers, Secretaries and on CBI on 30-03-2012. This clearly confirms that the issue of the correctness of FIR has not yet been established. The replies to these Notices have to be filed. It will take some time for the disposal of the SLP. The CBI cannot disrespect the order of the Supreme Court.

Despite such merit in his arguments, the CBI did not relent. Mr Jaganmohan Reddy cancelled his campaigning and dutifully attended the CBI enquiry. After three days of investigation, they promptly arrested him, as the whole world was expecting. It is no secret that YSR Congress has gained an unprecedented ground in the State, the losers being the Congress Party and the TDP. Both of them have phenomenal clout with Media and various institutions, having been in power for more than 50 years. They are misusing every institution with impunity. They have been carrying on a systematic vilification campaign against Mr Jaganmohan Reddy that he amassed one lakh crores of rupees, while the fact remains that the CBI during the last 270 odd days of their deep investigation could not trace even 1% of that amount. Not only that, the CBI could not come up with one item that was already not disclosed to various institutions like ROC and IT several years ago.

It is no secret that in all CBI cases involving senior political leaders, they act according to the instructions of Central Government, which is presently the Congress led UPA Government. Naturally, the CBI is serving the interest of the Congress Party and is using its high hand to crush the political dissent. It is relevant to recall that all political parties cutting across Party lines, during the recent debate on Lok Pal Bill in both the Houses of Parliament, have decried the brazen misuse of CBI by the Central Government to silence the Political dissent.

I have no choice, therefore, except to approach you requesting your kind intervention. Sir, I request you to kindly direct the CBI to immediate release Mr Jaganmohan Reddy. They have waited for waited for 270 odd days; they can wait for another 15 days, particularly when there is no possibility, whatsoever, for tampering the evidence. I request you to this in the larger interest of democracy and for free and far elections.
