Breather for Dutt; govt not to appeal against his acquittal
New Delhi: The Attorney General GE Vahanvati has given opinion against challenging the acquittal of Sanjay Dutt under TADA. The Law Ministry had sought the Attorney General's opinion on filing an appeal against Dutt's acquittal.

Dutt was acquitted of terror charges under TADA, but convicted under the Arms Act two years ago.

On July 31, 2007, TADA special judge P D Kode had sentenced Dutt to six years of rigorous imprisonment under the Arms Act. Dutt had moved Supreme Court challenging his conviction and has been on bail since. He was granted bail in August 2007.

In 2008, the Additional Solicitor General had advised against filing such an appeal. He had said that the evidence gathered by CBI was not enough to frame charges under TADA against Dutt.

However, the final decision will have to be taken by the CBI. The CBI wanted the opinion to be reviewed because it felt the stand might affect others in the blast case.
