An NDTV investigation has revealed how the legal system may have been subverted in the high profile BMW case.

In 1999 six people were run over, allegedly by a BMW driven by Sanjeev Nanda, a young, rich industrialist. But eight years later every witness, except one, turned hostile.

NDTV investigates how the prosecution, the defence, and the only witness, who has not turned hostile, Sunil Kulkarni collude.

The story is not only a comment on an isolated, single case but a larger statement on the state of India's legal system.

Two months ago, Kulkarni approached NDTV after watching the channel's expose on the BMW case.

Kulkarni claimed he was under great pressure from both sides- the Defence and the Prosecution, to change his original statement . He offered to prove this on hidden camera. But just before his testimony began, he withdrew his initial consent.

After consulting legal opinion, NDTV broadcast the story in public interest.

There are four main players in the BMW case:

  • Sanjeev Nanda, son of a rich arms dealer, accused of running over and killing six people in his BMW. The car was later filmed by the police with blood on its wheels. Nanda got bail after 9 months in jail when the only survivor changed his story and said a truck and not a BMW caused the accident.

  • Sunil Kulkarni, a passerby who allegedly saw the accident and the only witness who has refused to turn hostile but was inexplicably dropped as a witness by the prosecution on grounds that he had been bought by the Nandas. This despite the fact that he is the only witness who still says the accident was caused by a black car with two men in it, one of them called Sanjeev.

  • R K Anand, the Defence lawyer for Sanjeev Nanda, one of the senior most lawyers in India and a former Rajya Sabha MP.

  • Public Prosecutor I U Khan who is meant to prove the killing.
But over-ruling the prosecution, which had refused to let Kulkarni testify in March this year, the court hearing the case summoned Kulkarni as a witness.

This is when he approached NDTV to catch on hidden camera the pressure he claims he's under to change his testimony.

His first meeting was with the prosecutor on April 28.

Kulkarni: Why have I been summoned now?

Khan: We dropped you. The court has called you.

Kulkarni: I think the state asked you to drop me, right?

Khan: These are the instructions I received from the HQ. And that's why I got the SHO statement recorded that "on the instructions of the SHO and the ACP, such-and-such witness has been dropped". How can I make a statement? My clients are Delhi Police. Whatever instructions they give, I will act upon it.

Kulkarni: So this headache?

Khan: You won't have it. They've petitioned the High Court that Kulkarni's statement should not be recorded.

Kulkarni: So it won't be recorded, right?

Khan: No. Relax. Who is the court to say you should be examined?

The public prosecutor then asked if the witness has met bade sahib. Kulkarni claims the bade sahib they are talking about is R K Anand, the lawyer representing Sanjeev Nanda.

Khan: You've met bade sahib?

Kulkarni: No

Khan: Really?

A few days later the witness meets R K Anand, Sanjeev Nanda's defence lawyer at the airport.

Kulkarni: Khan has told you that he met me.

Anand: Yes

Kulkarni: So what is our strategy now?

Anand: I'll be back in town tomorrow. Meet me at home.

Then comes the key moment where money is discussed. The defence lawyer and Kulkarni talk about how much money to ask for.

Kulkarni: Should I ask for Rs 2.5 crore?

Anand: Ask for Rs 5 crore and I will cross-examine you.

Kulkarni: So you will cross-examine me...

Anand laughs

Is this, as Kulkarni the witness says, Anand's way of guaranteeing that only he and no other lawyer will do the cross examination?

It doesn't end here. R K Anand has another meeting with Kulkarni in his own car. Here Anand negotiates on behalf of the Nandas.

Defence Lawyer meets Prosecution Witness on May 8

Kulkarni: What are we discussing?

Anand: Be reasonable.

Kulkarni: You decide.

Anand: No, you decide. Anyhow, what statement you are supposed to make, we will decide about it. First of all, meet the bugger and talk to him. And be reasonable. Don't be unreasonable like what you told me that day. Don't be silly.

Kulkarni: So how much?

Anand: Forget it. Life makes big demands of us.

Kulkarni: So Sanjeev must be saved.

Anand: Yes. Never harm anyone.

Kulkarni: But Khan and you tell me what has to be done. It was merely an accident. It was not murder.

Anand: And he remained in jail for 8-9 months.

A few hours later Kulkarni claims he is asked to meet Anand's assistant at a crowded market near Anand's office.

He introduces Kulkarni to a man sent to negotiate how much Kulkarni will be paid to change his testimony.

Kulkarni: Now what? And how? Anand and Kulkarni have to decide whether I testify on May 14.

Lovely: Ok

Kulkarni: The Nandas need me now, they're sending me messages but I won't meet them without Boss.

Lovely: Fine.

Kulkarni: So now?

Lovely: Tell me your demand. We have to settle the matter.

Kulkarni: That Boss has to decide.

Lovely: He wants you to decide. I'm the middleman. I'll handle it.

Kulkarni: So then you decide. I am testifying for the first time. I have no idea.

Lovely: The party is rich. Ask for Rs 60-70 lakh?

Kulkarni: That's nothing.

Lovely: Then you decide.

Kulkarni: And things like changing my testimony- that Khan and boss Mr Anand have to decide. And I will not meet Nanda alone. And no other lawyer should be involved. This is my condition.

Lovely: Should I say Rs one crore.

Kulkarni: Ask for Rs 2 crore.

Lovely: They won't agree.

Kulkarni: Then it's 10 years in jail.

Lovely If they don't agree, then how much?

Kulkarni: How can they disagree? Why approach me then? I have not volunteered.

Lovely: Fine, I'll say 2. But I think 1 is fine.

Kulkarni: Payment by tomorrow?

Lovely: Not so soon. It'll take a day to talk to the Nandas. I'll speak to Boss. He'll call the Nandas. Then I'll meet you.

Kulkarni: Tell boss, he and I will share this. Your cut?

No Doctor can have a remedy for this type of new sickness. NDTV has done a remarkable job in exposing Public prosecutor IU Khan in the famous MBW case.As of my opinion such Persons are not capable to hold such prime positions in the Judiciary.They should be immediately stripped off their job, and their license to work as an advocate and act Public prosecutor be cancelled, only then it can become an example for other Public prosecutors.They should be barred from Law profession for ever.

In the entire coverage thus far, it is Kapil Sibbal who stands out. Here is a cabinet minister (erstwhile eminent lawyer)who was not in the least surprised over the revelations and said that they were always aware of such activities (witnesses being bought over) and that it was merely a tip of the iceberg! Its a pity that people in the highest echelons, a cabinet minister at that, prefer to lie dogo rather than fight this menace of corruption in our judicial system!! Kudos to you, NDTV.

Congragulations to ndtv.You have done a fentastic job.You have done some thing our so called poletical leaders could not do or did not want to do.The culprits deserve the severest possible punishment for trying to sabotage the criminal justice system for which they vow thier very existence.The bar council shuld immediatley take up the issue and expel such corrupt elements.If they donot act now it could only mean that they are also colluding with the culprits. Congrats NDTV on the EXPOSE, MR.R.K.Anand has been defending high profile criminals from congress party and he finally joined congress party for the favors HE HAS done. And now there should a sting on high profile media savvy lawyers like Jethmalani, Kapil Sibal, Abhisek Singvi, Majid Memon , Kamini Jaiswal ,Salmam Khursheed etc .. who are responsible for defending Anti-nationals and terrorists who are involved in killing innocents by hundreds and are rarely Prosecuted b’cse they are well represented by these very lawyers. HAVE YOU EVER SEEN THESE HIGH PROFILE LAWYERS DEFENDING THE VICTIMS OF TERRORISM OR POOR VICTIMS LIKE IN THE BMW CASE?

I havent followed the case closely...but what baffels me is that we see a car owned by Nanda...which is smashed after an accident...6 people dead..and theres a case for the last 10 years looking for the culprit. What is Mr. Anand going to prove... GOD driving the car that night!!

think about the lower courts in the small towns of our country, i have heard you can just buy the judiciary and you are supposed to bribe to get the post of a public proscecutor.. what ever ndtv has done only confirms what we have been hearing as speculative... this case being high profile... has got the necessary attention and necessary funding by ndtv for carrying out the operation... what about those innumerable cases where injustice is meted out like more than how justice should have been... that such a thing happens is known to most of us... how do you stop it... most of us are the creators of this evil...

Great reporting of the bmw case & dont give up on this story soon, ensure that these 2 men are taken to their logical conclusion, they should not be any more with the law, their licence should be taken. They are still claming they are inocent. There should be a law that if someone is assumed guilty, he should be asked if he admits to it, if he does so the punishment should be as less than regular, but if he does not admit & later is proved guilty, then harsh punisment should be given & be publicised so it becomes a detterant.

Let us not blame the judiciary for this muddle. Judges are not involved in any way. It is the legal profession , I mean the lawyers who are neck deep involved in this. Both the Public Prosecutor and the Defence lawyer should be put on the mat.If they are involved in trying to protect guilty and make money in the bargain as S C once observed such should hang by lamp post,if they are proved guilty , law permitting. These are making a shamble of the system. Mere cancellation Licence to Practice will not suffice.It is like cancelling the Licence to possess Fire Arms if the person committed a crime with a fire Arm.

In 1999 6 Innocent Lives was lost and today like Cats and Dogss there is a fight between the Prosecution, Defence and the Witness to protect 1 Person who drove the BMW Car who has the Money Power to Purchase Witnesses. None on them is prepared to Accept his mistake for the Sake of those 6 Innocent Lives. Nobody is thinking of the family of those 6 Innocent Victims.

do u need more proof than this to convict the accused immediately without delay and order greater punishment to the accused ? Besides, those involved in trying to get favourable judgement by spending enormous money should also be punished. Person/s responsible for this exposure should not only be properly recognised, honoured and rewarded, but also given police protection.

It is just the tip of the iceberg of the rot in our socio-legal system not only in BMW case but elsewhere. This is not the first time this has happened. There is blatant misuse of laws of the land by so called high profile people. The colluding between the defence laywer, the public prosecutor and the key witness in the high profile BMW hit and run case is shameful and disgusting to me. Seeing and hearing RK Anand and IU Khan justify their wrong doings is further depressing. Congratulations to NDTV.. Am rememberd of a the below lines... Learning is not virtue but the means to bring us an aquaintance with it. Integrity without knowledge is weak and useless, and knowledge without integrity is dangerous and dreadful. This episode reinforces my belife that we cant as a nation rule ourselfs. We lack a basic model of equality and justice, as defined by western thought. Look at what happened in the Jessica Lal case.The last is yet to be heard on this. Every time this time of story is telecast, debates are also simultaneously telecast condeming such incidents and need to cleanse the rotten system. Matter ends and we wait for another scoop. How many Nitahris, Khan and Anannd colluding, Jassica like cases.... and the list is unendind. Media has been awakening but who will shake up the system. Where is the solution. Why not introduce barberic Arab kind of laws of chopping of limbs or publically pronounced punishment sa deterent.

One has got used to seeing justice being dispensed only when the media takes up the cudgels. Dangerous trend this. Soon you will be seeing people flocking to the media pleading for justice rather than going to the courts. This exposes far bigger issues than simply covicting Sanjeev Nanda. In any other country the ombudsman would have initiated proceedings against the two lawyers banning them for the rest of their lives. Corrupt judges, corrupt lawyers, corrupt witnesses, how long before the power corrupts the media? And then what?

Delhi is still functioning as it used to in Moghal Rule. Rich and influential people can buy justice. If poor witnesses do not turn hostile, they can be eliminated or threatened. Criminal lawyers and public prosecutors break law all the time and get protection from most feudal party amongst the ruling UPA.

NDTV deserves big congratulations. The story would not be much different if you or your family member or me or any other common people are killed by these powerful goons. Nandas (both the father and the son) deserve the most severe punishment. The lawyers (particularly the public prosecutor) also need to be punished by the court.

watched ur sting operation on bmw case. its shocking.u hear of corruption, people taking or offering bribe but wen u hear of such thing happeng n judiciary, its shameful.where a common man wld go nd get justice.these big lawyers hve no value, i guess of anything.iam law student, who shd b our insipration, r bringing shame not only 2 judiciary but country as well.but i loved the way barkha dutt, qs anand.keep up good work.congrats 2 whole team who was involved n process. pls reply on gvn email id.thanks

In this age where evrything seems to be for sale, at least some sections of media seems to be doing the right thing fearlessly. Without channels like NDTV joining in Jessica Lal would never have got justice. I hope that ths story has a similar impact. Murder or carelessness, the loss human life cannot be overlooked. Culprits need to pay the price and law has to guarantee that.

aap ka prayas sahi hai lekin.aaj har shahar ki gali mai ye aam bat hai.advocate ab kanun ke dalal hai.jaj, bade vakil banana nahi chate. jinko koi kam nahi milta vo jaj banta hai.court ab faisla nahi vyavastha de rahe hai.yahi karan hai ki court ke bahar souda hota hai.mandi lagti hai.bas khariddar hona chahiye.neta ko gali bakna aasan hai.par court mai jaj khud jab vakil tha to peshi badane 50rs deta tha.phir vah khamosh kyun rahta hai.

First, Do not address such lawyers as Sir or Mr when taking their interview on TV. These lawyers have lost their dignity and respect. They are worst than the actual criminal.

This ongoing BMW Story R.K Nanda the cruel Hero and the accused Sanjeev Nanda are trying with their extreme power of money to end it as "maayi ka lal paida nahi hua apney khilaf bholney ko".....But Kulkarni clear stand on his words and the Hidden magic camera should be considered seriously in the court hearing...and no words from defence lawyer must be heard before any proof of his innocence of his appearance in the camera...

This story is not shocking but just an exposure of our judiciary system. It is happening in day to day life. Good to see at least someone has taken step to expose this against a strong lawyer lobby

it is our misfortune that people like anand, khan etc wear the cloaks of lawyers. our country is very unfortunate. sometimes i really wish i was a vigilante, with a machinegun in my hand. i wish i was an amitabh like character from hindi films of the 70s. the saddest part is r k anand tommorrow will say this is a conspiracy to malign him, day after tommorrow half the country will forget, and next week onwards life will be the same again. request ndtv, and kulkarni to do all possible to put anand, khan and team behind bars for the rest of their lives.

Kapil Sibal and and Singhvi are saying that this is prevalent and the justice system is rotting but are not ready to comment on this case or blame RK Anand/IU Khan. This explains the reasons for the rot.

Every body knowes money talks iN INDIA. You can buy any thing with money in india. If rich peopel envolve in it. this is not new. Could you bring any story where rich got punished. always poor people suffer. this IS NOT NEW. yOU ARE NOT DOING ANY GOOD TO PUBLIC MAY BE YOUR INTERESTED HIDDING IN THIS MATTER. mAY BE YOU WANT TO FIX SOMETHING WITH NANDA.
