Aarushi murder trial: Order on framing of charges today

Tomorrow will be a crucial day for the Talwars'. The Ghaziabad will most likely decide whether the Talwars will be tried for murder, conspiracy and misleading the court or will it drop the case against the couple.
May 23, 2012
13:18 (IST)
The defence team then went on to tell the court that on the night of the murder, it was likely that Hemraj allowed his friends into the Talwar's home after the couple had gone to sleep.  The group then had drinks on the terrace, and some of the outsiders then went inside the home and tried to attack Aarushi in her room. The Talwars' lawyers say she was killed for resisting the assault.  When the attackers went back to the roof and reported what had happened, they say, Hemraj may have tried to hit them.  In retaliation, they allege, he was killed. The Talwars' argue that both victims were killed using a sharp knife or "Khukri."
May 23, 2012
12:29 (IST)
On Wednesday, when proceedings began in the Ghaziabad court hearing the framing of charges against the Talwars', their lawyers asked for a golf stick to be produced in court.  This because the CBI had in its investigation, said that the injuries found on 13-year-old Aarushi were caused by a golf club found in the Talwars' home, and a sharp object.

The lawyers showed the judge a similar golf club in court today to prove that the investigators' allegations are incorrect.

The Talwars have defended themselves saying that just because they were in the house didn't mean they had murdered their daughter.  An emotional appeal saying a mother cannot murder her daughter was also made. CBI also told the court how the Talwars filed false affidavits and also gave false information in the FIR registered after Aarushi's death. The lawyers for the Talwars then argued saying all the evidence is circumstantial evidence and the CBI had no direct evidence. The arguments will continue after lunch.

For those who came in late: Nupur Talwar, accused with her husband Rajesh of the murders of their only child, 13-year-old Aarushi, and their domestic help, Hemraj, is likely be sent to the Dasna jail this evening.

Mrs Talwar was refused bail today by a CBI court in Ghaziabad, where the Talwars are to be tried for murder, criminal conspiracy and destruction of evidence.

Officials at the Dasna Jail say she will be kept tonight at Barrack No 13, which is reserved for women prisoners. And that there will be no special concessions for her in jail - she will get a TV set and newspapers.

Her lawyers will apply for bail in a sessions court this afternoon. If that petition is heard today and settled in her favour, Nupur Talwar will not be imprisoned.
